60 General Policies Access to Personnel and Medical Records Files New England Security maintains separate medical records files and personnel files for all employees. Files containing medical records are stored separate and apart from any business-related records in a safe, locked, inaccessible location. The medical file is the repository for sensitive and confidential information related to an individual's health, health benefits, health-related leave and/or accommodations, and benefits selections and coverage. Medical records are kept confidential in compliance with applicable laws and access is on a "needto-know" basis only. Supervisors and others in management may have access to your personnel file for possible employmentrelated decisions. If you wish to review your personnel or medical records file, you must give the Company reasonable notice. Inspection must occur in the presence of a Company representative. All requests by an outside party for information contained in your personnel file will be directed to the [[appropriate department]], which is the only department authorized to give out such information. Benefits Crime Victim Leave New England Security will permit you to take unpaid leave to participate in investigations, or court or other related legal proceedings, under the following circumstances: 1. Where you are the victim of a crime or attempted crime. 2. Where your immediate family member is a victim of a crime or attempted crime and is a minor. 3. Where your immediate family member is a victim of homicide. Immediate family member means your father, mother, stepparent, child, stepchild, sibling, spouse, grandparent, or legal guardian; or any person involved in an intimate relationship with you and residing in the same household. If you need to take crime victim leave, notify your Manager and make scheduling arrangements. The Company may request documentation supporting your need for leave. Leave under this policy will be unpaid; however, exempt employees may be paid as required by law. You may choose to use [[PTO/vacation]] for any unpaid leave. The Company will not retaliate against employees who request or take leave in accordance with this policy. Jury Duty Leave New England Security encourages employees to fulfill their civic duties related to jury duty. If you are summoned for jury duty, notify your Manager as soon as possible to make scheduling arrangements. Exempt employees will receive their normal salary less payments received for serving as a juror. Nonexempt employees will not be compensated for time spent on jury duty. You may opt to use [[PTO/vacation]] in place of unpaid leave. The Company reserves the right to require employees to provide proof of jury duty service to the extent authorized by law.
