37 Once vacation balances are exhausted, employees may request unpaid time off. Approval of unpaid time off requests are also subject to the needs of the business. The company reserves the right to black out certain days, weeks, holidays, or extended periods of time for which no vacation time will be granted to employees due to operational constraints. Part time field employees are not entitled to any paid PTO. They may request unpaid time off in writing to their direct supervisor at least 2 weeks in advance. 7.13 Severance Pay As a general rule, when severance pay is offered, an employee will be provided with one week of severance pay for every year of employment with the Company. To be entitled to severance pay, the employee must have worked at least three years with the Company and be a regular full-time employee at the time of separation. Any severance pay offered is at the discretion of New England Security management and requires the employee to sign a Release of Claims Agreement as a condition of payment. 7.14 Sick Pay SICK LEAVE - PPT (Pay Protected Time) Accrual of Sick Time All employees of the company whose primary place of employment is Massachusetts shall be eligible to accrue and use paid sick time. Sick time accrues at the rate of one (1) hour for every thirty (30) hours worked per benefit year [any consecutive 12-month period of time determined by the employer, including calendar year, fiscal year, tax year, or year based on date of hire], up to a maximum of 40 hours. For accrual purposes, exempt employees will be assumed to work 40 hours per week, unless they are normally scheduled to work fewer than 40 hours, in which case earned sick time accrues based on their regular schedule. Use of Sick Time Employees may use up to 40 hours of accrued sick time per benefit year. Accrual of sick time begins on the employee's first date of actual work, but employees may not use such earned sick time until 90 calendar days after their start date. Sick time cannot be used in conjunction with earned vacation time. For extended periods of absence, sick time must be exhausted before vacation time applies. Sick time is provided to allow employees to: 1. Care for the employee's own physical or mental illness, injury, or other medical condition that requires home, preventative, or professional care; 2. Care for a child, parent, spouse, or parent of a spouse who is suffering from a physical or mental illness, injury, or other medical condition that requires home, preventative or professional care; 3. Attend routine medical and dental appointments for themselves or for their child, parent, spouse, or parent of a spouse; 4. Address the psychological, physical, or legal effects of domestic violence; or
